State legislation requires that students who fail to meet the minimum achievement level necessary to graduate shall be offered supplemental educational programs designed to improve student achievement in English language arts, mathematics, science, or social studies. This supplemental remedial education shall comply with regulations adopted by the State Board of Elementary and Secondary Education (SBESE) and shall be funded in part with a state appropriation specifically for such purpose.

The purpose of supplemental remedial instruction is to provide standards-based instruction and assessments to eligible students in an effort to increase their scores above the Unsatisfactory achievement level on the Graduation Exit Exam (GEE).

Remediation classes may be offered during the current school year or in the summer of 2008. School districts are to offer a minimum of fifty hours of remediation each year for students who do not pass the GEE.
