The Office of Legislative Services is dedicated to researching and advocating for education
policies that contribute to the Louisiana Department of Education’s (LDOE) vision to
create a world-class education system in Louisiana. Through ollaborations with policy makers at every level, including the Governor’s Office, Board of Elementary and Secondary

LDOE to Post Weekly Legislative Updates
Through its Legislative Bulletin, LDOE will provide members of the public with information
regarding proposed legislation that could potentially impact the state’s P-K – 12 education
programs. Please see below for links to proposed legislation as well as a brief description. LDOE will continue to monitor these bills and provide updates through this publication.
Four Bills Aim to Reform Local School Board Governance
Rep Steve Carter, R-Baton Rouge, is proposing four bills that could reshape the way local school boards and superintendents do business. Already much debate has been sparked
surrounding the issues.
HB 371, if approved, would redefine the nepotism policies in school districts, restricting hiring and promotions by the superintendent of immediate family members in certain
parishes.
HB 664 seeks to establish term limits that would mean no school board member elected
after Jan. 1 2010 will be allowed to serve more than two-and-a-half four-year terms.
HB 808 would eliminate the up to $800 monthly stipends local board members receive. The proposed law would give board members $50 for each meeting they attended each
month, up to $200 monthly.
Board members would not be allowed to influence or determine personnel decisions if HB 851 is approved. Additionally, the bill would require boards to obtain a supermajority,
or two-thirds vote, to hire and fire a local superintendent.
Baton Rouge Representative Introduces Bill to Eliminate BESE
Rep. Joe Harrison, R-Baton Rouge, filed a bill (HB 496) that would, if approved, abolish
the State Board of Elementary and Secondary Education and transfer the board’s powers to the state superintendent. The measure would also require the governor to appoint a state superintendent, who would authorize the state superintendent to develop and propose a funding formula for the state’s public school districts and develop qualifications and duties of parish superintendents.
Group of Lawmakers Seeking to Establish Academic Requirements
for Athletes
Rep. Rickey Hardy, D-Lafayette, and others, are seeking to require that all students in grades 6-12 who participate in interscholastic athletics and other extracurricular activities have a GPA of at least a 2.0 on a 4.0 grading scale to be eligible for participation.
The proposed law would mandate the state Board of Elementary and Secondary Education to adopt a policy which, at a minimum, requires students to attain no less than a passing grade in each course of study for the previous grading period and maintain and receive at least a 2.0 GPA on a 4.0 scale (or its equivalent) for all courses of study for the year eligibility for participation in any interscholastic athletic or other extracurricular activity. The proposed law would also require BESE to review its policy and adopt new rules as necessary to ensure the minimum standards are maintained.
Shreveport Representative Seeks to Abolish Corporal Punishment in Schools
State Rep. Barbara Norton, D-Shreveport, is proposing corporal punished be banned in all public elementary and secondary
schools.
The proposed bill would require school boards to prohibit corporal punishment in public schools and to adopt rules
and regulations for the prohibition. The bill also requires school boards give parent orientations that include policies
on the prohibition of corporal punishment.

2. BESE/LDOE Authored Legislation
HB 89 (Burford): The proposed law deletes the requirement in an existing law that school systems participating in LA 4 maintain, in each year of participation maintain the same level of funding from any source for early childhood education as provided in the previous year before participation.

HB 183 (Hoffman): The proposed law authorizes BESE to establish an appeal process to the Teacher Certification Appeals Council
and allow the state superintendent to appoint nine members to the Teacher Certification Appeals Council. Those who are appointed to the council must be nominees from various professional organizations; appointees and membership terms are approved by BESE.

HB 223 (Armes): Provides relative to noncomplex health procedures performed by certain school employees, changes references to “outside tracheostomy suctioning” to “tracheostomy suctioning.”

HB 545 (Ritchie): Requires principals of public schools where a student was enrolled to release the student’s records to a public or nonpublic school (inside or outside Louisiana) where the student is enrolled or seeking enrollment. Also requires records to contain information on suspension and expulsion.

HB 602 (LeBas): Permits certain public school students to carry and self-administer certain medications under certain circumstances. Proposed law adds requirement to existing law that governing authority of each public school permit the self-administration of medications by a student with asthma or the use of auto-injectable epinephrine by student at risk of anaphylaxis if the parent or legal guardian provides the school with certain documentation. Proposed law also provides for a limitation of liability for the school and it employees relative to self-administration of medication and disciplinary consequences for misuse of medications.

HB 686 (Carmody): Requires BESE to engage in a charter-school application review process that complies with the latest Principals and Standards for Quality Charter School Authorizing as specified by the National Association of Charter School Authorizers. Also provides for an independent evaluation of a proposal by a qualified third party.

HB 114--Hardy--Provides that any member of TRSL who returns to active service as a classroom teacher offering instructional services to students within the 12-month period immediately following his retirement shall have his retirement benefits suspended for the duration of such active service or for 12 months, whichever occurs first. It the reemployment of a person who retired from a position as a classroom teacher offering instructional services to students is based on an agreement between that person and his employer where such agreement was perfected prior to the person’s retirement, that person so reemployed shall not receive retirement benefits for the 12-month period following the reemployment. During the period of reemployment, the salary of a retiree who is reemployed by a employer in the TRSL system in any position other than classroom teacher offering instructional services to students shall be limited to the salary they would be paid by that particular employer to a classroom teacher offering instructional services to students who have zero years of teaching experience and a bachelor’s degree. Any TRSL retiree who is reemployed in any position other than classroom teacher offering instructional services to students shall have his benefits suspended for the duration of his period of reemployment.
